Dear Colonial CC Owner,

The Master Board of Directors has formed an Ad Hoc Committee charged
with the task of updating our governing documents, primarily because
they were written for the convenience of Pulte, the developer, not for the
best homeowner representation and the effective management of our club.
We wanted you to know what this is all about and welcome any
comments or suggestions you may have about this topic.
First, the Ad Hoc Committee is a temporary working group that has no
policy making ability or authority. They are simply coordinating possible
language changes to the documents that will have to be approved first by
the Master Board and then the owners through your Voting
Representatives.Second, they are editing the existing documents rather than writing new
ones based upon legal recommendations. We also think that this will
make it easier for you to see exactly what changes are proposed.
Third, they are looking into a number of issues in the Declaration of
Covenants, the By-Laws, and the Articles of Incorporation that may
warrant changes to the documents. Some of these issues include:
1. Consider deleting unnecessary and no longer applicable wording relative to the Developer.

2. Consider moving the date of the annual meetings and Board of Directors elections to January so that more of you can be here to participate. By the way, the July date was originally driven by the Pulte turn-over - probably not the best considering the realities of our community. This may involve extending the terms of the present Board members by 6 months from July 2008 to January 2009.

3. Consider changing the Covenants to allow private golf cart usage on the course subject to certain restrictions, rules, and fees determined by the Board from time to time as circumstances dictate.
Right now private carts are not allowed by the Covenant.

4. Examine the voting processes, quorums, etc. Right now, there appear to be some inconsistencies surrounding these areas.

5. Examine the ARC and Use Restrictions policies and processes visą-vis the Neighborhood HOA's and the Master Association, and clarify enforcement provisions. 
These areas are now somewhat confusing, and may or may not be contradictory to other language in the documents that appear to require consistent community wide standards.
 
6. Consider clarifying that the Master Association can provideservices such as landscaping and property management if desired by both the Neighborhood Association and the Master Association.
This would simply clarify that it is allowed to happen; it would not require it to happen.

7. Consider redefining the role of President of the Master Association Board. Several owners have expressed discomfort with the implications of the use of the term "CEO".

These are all simply potential changes and none will go forward for approval until after thorough legal review and careful consideration by the Master Board. We believe that your collective opinion will have a lot to do with which, if any, of these potential changes will ultimately be approved or not. Moreover, there may be other items that arise as the work continues, so bear with us as we sort all of this out. Please note that any potential mendments to the above documents may also require approval of your Neighborhood Voting Representatives, probably later this year or early next. We have also asked the Ad Hoc Committee to update the Rules and Regulations, and the Membership Plans to reflect current operating practices, and clarify some of the rules. We plan to get you a list of proposed updates to these documents as soon as it is available. Also note that changes to these two documents can be made with the approval of a majority of the Master Board, and do not have to be approved directly by owners (or your Voting Representatives).
